The Texas Education Agency (TEA) adopts an amendment to §129.1047, concerning truancy sanctions. The amendment is adopted without changes to the proposed text as published in the September 26, 2025 issue of the Texas Register (50 TexReg 6281) and will not be republished. The adopted amendment aligns the rule with statute and the current agency investigative process.

REASONED JUSTIFICATION: Section 129.1047 establishes criteria for sanctions regarding truancy.

The adopted amendment removes former §129.1047(b) and (c) to align with current program practices.

Section 129.1047(d) was re-lettered as new subsection (b), and language was added to specify that sanctions related to truancy prevention measures are subject to a school district's due process rights under Texas Education Code (TEC), Chapter 39, Subchapter A. In addition, a reference to TEC, §39.102(a), was updated to §39A.002.

SUMMARY OF COMMENTS AND AGENCY RESPONSES: The public comment period on the proposal began September 26, 2025, and ended October 27, 2025. No public comments were received.

STATUTORY AUTHORITY. The amendment is adopted under Texas Education Code, §25.0915, which establishes truancy prevention measures.

CROSS REFERENCE TO STATUTE. The amendment implements Texas Education Code, §25.0915.

The agency certifies that legal counsel has reviewed the adoption and found it to be a valid exercise of the agency's legal authority.
